  • Misleading the Public: Individuals transitioning from traditional e-cigs often turn to ‘zero nicotine’ vapes as part of their quitting journey.
  • Risks to Children: These ‘nicotine-free’ vapes can be sold to minors, potentially exposing them to unadvertised nicotine.
  • Scope of the Issue: An astonishing 33% of the 43 tested ‘zero nicotine’ products contained noticeable amounts of nicotine.

The Regulatory Shortfall

The vaping industry is at a regulatory crossroads. While legislation focuses primarily on nicotine-containing products, ‘zero nicotine’ vapes often fly under the radar, escaping most e-cig regulations. This loophole allows some unscrupulous manufacturers and retailers to mislabel their products, endangering consumers in the process.

Robert Sidebottom, the Managing Director of Arcus Compliance, highlighted the critical need for comprehensive regulation. Every vaping product, irrespective of its nicotine content, should undergo stringent testing to ensure it does not contain prohibited substances or unadvertised nicotine.

Looking at the Numbers

Recent research, shared exclusively with ITV News, paints a concerning picture:

  • 300,000 vapes, believed to be illegal, were seized in the last three years by UK trading standards.
  • This data, sourced from Freedom of Information requests by Arcus Compliance, also shows that more than 700 inspections, raids, and test purchases have occurred.

A Concerning Trend

It’s also worth noting that in previous months, disposable vapes had to be withdrawn from major retailers. Why? They were found to contain higher doses of nicotine than advertised. Such incidents further emphasize the urgent need for greater regulation.
